Why do I need a statutory declaration for my withdrawal?

If we’ve asked you for a statutory declaration (often called a "stat dec"), it’s because we’re required to collect one for certain KiwiSaver withdrawals.

A statutory declaration is a written statement that you sign in front of an authorised person (such as a Justice of the Peace or a lawyer) to confirm that the information you’ve provided is true.

When is it required?

Under the KiwiSaver Act 2006, we need a statutory declaration for certain types of withdrawals, including:

  • Significant Financial Hardship
  • Serious Illness
  • Life-Shortening Congenital Conditions
  • Permanent Emigration
  • First Home
  • Deceased Estate
  • Foreign superannuation tax liability withdrawal form
     

For retirement withdrawals, we only require a statutory declaration for your initial withdrawal. This helps us confirm your eligibility to receive any Government contributions included in your withdrawal. The good news is that for any subsequent retirement withdrawals, you won’t need to provide another stat dec.

What do I need to do?

  • Complete the statutory declaration form we’ve provided. Please ensure you’ve got the right stat dec for the withdrawal type you’re requesting.
  • Have it signed and witnessed by an authorised person (for example, a Justice of the Peace or lawyer).
  • Make sure you bring photo identification (e.g. passport or driver’s license), as this may also need to be verified as part of your withdrawal (the withdrawal form will outline all the requirements). 

Need help finding someone to witness it?

You can find a Justice of the Peace:

  • At most citizens advice bureaus
  • The Federation of NZ Justices has a search page to find one located near you:  Royal Federation of NZ Justices' Associations
  • Libraries in Auckland are visited by Justices of the Peace and these are advertised on the local library websites.
